Neurodiversity can be considered a disability under the Equality Act 2010 if it has a substantial and long-term negative effect on a person's ability to do normal day-to-day activities.
The Equality Act defines a disability as an impairment that: Makes it harder to do everyday activities and has a long-term effect.
A medical diagnosis is not required to establish disability. The Equality Act's definition of disability is broad, so someone with neurodiversity might be considered disabled even if they don't see themselves as disabled.
If an employee with Neurodiversity is considered disabled, their employer has a duty to make reasonable adjustments to their role.
